1. Acceptance of Terms

By downloading, installing, or using ComiCal ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and ComiCal ("we," "us," or "our").

2. Description of Service

ComiCal is a digital journaling application that allows users to:

  • Create and manage daily journal entries
  • Upload and organize photos
  • Generate AI-powered images and videos based on journal content
  • Track moods, tasks, and daily activities
  • Monitor screen time usage (with permission)
  • Create and share multimedia content

3. Eligibility

You must be at least 13 years old to use ComiCal. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18, you must have permission from a parent or legal guardian to use the App and make purchases.

4. Account Registration

4.1 Account Creation

  • You must create an account using Apple Sign-In or Google Sign-In
  • You are responsible for maintaining the confidentiality of your account
  • You are responsible for all activities that occur under your account
  • You must provide accurate and complete information

4.2 Account Security

  • You must notify us immediately of any unauthorized use of your account
  • We are not liable for any loss or damage arising from unauthorized account access
  • You may not share your account with others

4.3 Account Termination

  • You may delete your account at any time through the App settings
  • We reserve the right to suspend or terminate accounts that violate these Terms
  • Upon termination, your data will be deleted in accordance with our Privacy Policy

5. Subscriptions and Payments

5.1 Subscription Plans

ComiCal offers the following subscription plans:

  • Pro Monthly: $9.99/month - 300 credits per month
  • Pro Yearly: $79.99/year - 400 credits per month

5.2 Credit System

  • Free Credits: New users receive 30 free credits upon signup
  • Subscription Credits: Reset monthly and do not roll over
  • Purchased Credits: Available only to Pro subscribers and never expire
  • Credit Costs:
    • AI Image Generation: 4 credits
    • AI Video (Fast): 30 credits
    • AI Video (Standard): 80 credits
    • Slideshow Videos: Free for Pro subscribers

5.3 Payment Terms

  • All payments are processed through Apple App Store
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • Subscription prices are subject to change with 30 days notice

5.4 Cancellation and Refunds

  • You can cancel your subscription anytime through your App Store account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods
  • Refund requests must be made through Apple App Store
  • We reserve the right to refuse refunds for violations of these Terms

6. Acceptable Use

6.1 Permitted Use

You may use ComiCal for:

  • Personal journaling and self-expression
  • Creating and storing personal memories
  • Generating AI content for personal use
  • Tracking personal goals and activities

6.2 Prohibited Use

You may NOT:

  • Use the App for any illegal purpose
  • Upload content that violates intellectual property rights
  • Upload content that is offensive, harmful, or inappropriate
  • Attempt to reverse engineer, decompile, or hack the App
  • Use automated systems or bots to access the App
  • Resell or redistribute generated content commercially without permission
  • Share your account credentials with others
  • Create multiple accounts to abuse free credits or trials
  • Use the App to harass, abuse, or harm others

7. Intellectual Property Rights

7.1 Your Content

  • You retain ownership of your journal entries, photos, and uploaded content
  • By using the App, you grant us a license to store, process, and display your content
  • This license is necessary to provide the service (e.g., AI generation, cloud sync)
  • You can delete your content at any time

7.2 AI-Generated Content

  • AI-generated images and videos are created based on your journal entries
  • You have a non-exclusive license to use AI-generated content for personal use
  • Commercial use of AI-generated content may require additional licensing

7.3 Our Intellectual Property

  • ComiCal, including its design, features, and code, is our property
  • Our trademarks, logos, and branding are protected
  • You may not copy, modify, or distribute our intellectual property

8. Disclaimers and Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED
  • WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS
